Orange County Superior Court: What to Expect in a Lemon Law Case

Government building exterior representing Orange County Superior Court

When a manufacturer refuses to repurchase or replace a defective vehicle, the next stop for many Orange County drivers is a lawsuit in Orange County Superior Court. A lemon law case there follows a fixed sequence of filings, conferences, and deadlines, and that sequence changes depending on which procedures the manufacturer chose to follow.

Each step carries a deadline that can affect your claim. If the manufacturer’s answer is still no after repeated warranty repairs, Neale & Fhima can review your repair orders in a free initial consultation and explain how a lawsuit would unfold.

The Essentials

Where the case is heard, which procedures the manufacturer chose, and when it was filed all affect what an Orange County lemon law lawsuit looks like from start to finish:

  • Unlimited civil lemon law cases are filed electronically and heard at the Central Justice Center in Santa Ana.
  • Manufacturers that opted into newer state procedures face a compressed early schedule of disclosures, short depositions, and mediation.
  • Most pretrial hearings can be attended by Zoom, while trials take place in person.
  • The filing deadline depends on which set of procedures governs the vehicle.

Each point carries conditions, and the details matter for timing.

What Happens in an Orange County Superior Court Lemon Law Case?

Most Orange County lemon law lawsuits are filed electronically at the Central Justice Center in Santa Ana and move through case management, discovery, mediation, and, if unsettled, trial. Cases against manufacturers that opted into newer state procedures follow a faster early schedule.

Where Is an Orange County Superior Court Lemon Law Case Heard?

Lemon law lawsuits in Orange County are generally filed as unlimited civil cases and heard at the Central Justice Center, 700 Civic Center Drive West in Santa Ana. A case is unlimited when the amount in controversy exceeds $35,000, the ceiling for limited civil cases under Code of Civil Procedure section 85, and a repurchase claim often passes that figure.

The court’s own rules set the practical ground rules at that courthouse:

Court feature How it works in Orange County
Filing location Limited and unlimited civil cases go to the Central Justice Center, and complex cases go to the Civil Complex Center
Electronic filing Local Rule 352 requires represented parties to file electronically in civil actions
Remote appearances Law and motion matters, case management conferences, and other non-evidentiary hearings run on Zoom through online check-in
In-person proceedings Trials and evidentiary hearings are in person, and so are mandatory settlement conferences unless all parties agree otherwise and the court approves

A party can ask the court by motion to allow a remote trial or evidentiary hearing. We confirm the current rules before each hearing, since the court updates them by order.

Two Rulebooks for OC Superior Court Lemon Law Cases

Every lemon law lawsuit in Orange County follows one of two procedural tracks, and the manufacturer, not the court or the buyer, decides which one applies. The underlying rights still come from the Song-Beverly Consumer Warranty Act, but the pace and the filing deadline differ.

The Standard Song-Beverly Track

Claims against manufacturers that did not opt in proceed like other unlimited civil cases, with ordinary discovery and no statutory early-mediation deadline. Civil Code section 1794 allows a civil penalty of up to two times actual damages for a willful violation and lets a prevailing buyer recover attorney’s fees, costs, and expenses.

The Opt-In Track Under Section 871.20

Assembly Bill 1755 and Senate Bill 26 added a chapter to the Code of Civil Procedure that governs restitution and replacement claims only against manufacturers that elect it, for five consecutive calendar years at a time. The Arbitration Certification Program within the Department of Consumer Affairs publishes the list of electing manufacturers each year.

How Does a Lemon Law Case Move Through OC Superior Court?

A lemon law lawsuit in Orange County moves through a predictable series of events, with the first step reserved for the opt-in track:

  1. Pre-suit notice. To keep a civil penalty claim available against an electing manufacturer, the buyer sends a written repurchase or replacement demand at least 30 days before filing, under section 871.24, while still in possession of the vehicle.
  2. Complaint and service. The complaint is filed electronically and served with the court’s alternative dispute resolution (ADR) information package, as rule 3.221 of the California Rules of Court requires.
  3. The manufacturer’s response. The manufacturer files an answer, and on the opt-in track that date starts the early-case clock.
  4. Initial case management conference. The court gives at least 45 days’ notice, and its civil timeline calls for this conference within 180 days of filing. Each party files a case management statement at least 15 calendar days beforehand, under rule 3.725.
  5. Jury fee deposit. A party that wants a jury pays a nonrefundable $150 fee by the date of the initial case management conference, under Code of Civil Procedure section 631.
  6. Discovery, mediation, and trial. The parties exchange evidence, attempt to settle, and go to trial if the case does not resolve.

Settlement can end a case at any of these stages, and only you decide whether to accept an offer. If the case is tried, expect to testify about the defect and the repair visits.

What Happens in the First 150 Days on the Opt-In Track?

For electing manufacturers, section 871.26 packs disclosures, depositions, and mediation into roughly five months for actions filed on or after January 1, 2025. Each deadline runs from the date the manufacturer files its answer or other responsive pleading:

  • By day 60: every party provides initial disclosures and documents without waiting for a discovery request.
  • By day 90: the parties schedule mediation with a court-appointed or private mediator.
  • By day 120: each side may complete initial depositions of the buyer and the manufacturer’s person most qualified, each limited to two hours.
  • By day 150: the mediation takes place, attended by the buyer and someone with settlement authority for the manufacturer, in person or remotely.

All other discovery pauses until mediation ends, and the statute requires monetary sanctions against attorneys who miss the disclosure or deposition deadlines.

Records a Buyer Discloses Early

The buyer’s initial disclosure draws on records most owners already keep:

  • The purchase or lease agreement and current registration
  • Financing documents and payment history
  • Every repair order for the vehicle
  • Receipts for towing, rental cars, and other incidental costs
  • Communications with the manufacturer before the lawsuit

The manufacturer produces warranty history, technical service bulletins, and recall information. Gathering your records early keeps the 60-day deadline manageable.

How Does Mediation Work in Orange County Superior Court?

Outside the opt-in track, mediation usually follows a referral at the first case management conference or a stipulation the parties file after everyone has appeared. The court expects ADR processes to finish within 90 days of assignment unless it orders otherwise.

Court Panel or Private Mediator

Mediators on the court’s civil mediation panel charge a reduced flat fee, shared by the parties, for the first two hours before moving to their regular rates. Private mediators bill at market rates from the start, and litigants with an approved fee waiver can use the court’s program without charge.

Lemon Law Filing Deadlines in Orange County Courts

The filing deadline depends on the track, and missing it can end even a well-documented claim.

Standard Track Deadline

The Song-Beverly Act sets no filing deadline of its own, so California courts have generally applied the four-year period in Commercial Code section 2725. When those four years begin can turn on the warranty’s terms and when the defect was or should have been discovered.

Opt-In Track Deadline

Against an electing manufacturer, section 871.21 requires filing within one year after the express warranty expires, and never later than six years after original delivery. Repair downtime, up to 60 days after a pre-suit notice, and the rules in Civil Code section 1793.22 can extend those periods, so the actual date depends on your records.

FAQs: Orange County Superior Court Lemon Law

Can a manufacturer move my lemon law case to federal court?

Sometimes. A manufacturer can try to remove a California lemon law lawsuit to federal court when the parties are citizens of different states and more than $75,000 is in controversy. The buyer can challenge removal, and a federal judge decides whether the case returns to Orange County Superior Court.

What is a 998 offer in a California lemon law case?

A 998 offer is a formal settlement offer under Code of Civil Procedure section 998. A buyer who rejects a manufacturer’s 998 offer and then fails to obtain a more favorable judgment loses post-offer costs and must pay the manufacturer’s costs from the offer date. An offer not accepted within 30 days, or before trial if sooner, is treated as withdrawn.

What is the Standardized SBA Release in a California lemon law case?

The Standardized SBA Release is the only release a manufacturer can require as a condition of a remedy under California’s opt-in lemon law procedures, according to section 871.25. It addresses the loan or lease payoff, restitution, title transfer, and attorney’s fees, which keeps a buyback from being tied to broader release language.

Does the early mediation schedule apply if I represent myself in a lemon law case?

No. The disclosure, deposition, and mediation deadlines in California Code of Civil Procedure section 871.26 do not apply to a party without counsel. Other opt-in rules, including the 30-day pre-suit notice needed to seek civil penalties, still apply to a self-represented buyer.

How can I look up a lemon law case in Orange County Superior Court?

The Orange County Superior Court’s online civil case access lets you search by case number or party name and view the register of actions. Most documents filed on or after January 1, 2008, can be viewed and downloaded for a fee.
